Does New York charge sales tax on a private-party car sale?

Yes. Buyer and seller complete Form DTF-802 and the buyer pays the sales tax at the DMV office when registering or titling; the DMV calculates the tax at the buyer's home-jurisdiction rate and issues a receipt. Tax is on the price paid, but if the price is below fair market value the seller must complete the DTF-802 affidavit; otherwise the buyer may have to pay tax on the fair market value established by the Tax Department and apply for a refund.
